Online Banking Agreement

This Online Banking Agreement ("Agreement") contains the terms and conditions that apply to your use of the Online Banking Service. By using the Online Banking Service, you agree to abide by the terms and conditions contained herein. This Agreement will be governed by and interpreted in accordance with federal law and regulation, and to the extent there is no applicable federal law or regulation, by the laws of the State of Illinois. If you do not agree to any of the terms and conditions contained in this Agreement, you may not use the Online Banking Service(s).

The following definitions apply to the terms contained in this Agreement:

“Online Banking” is defined as all products and services offered by this bank by means of the Internet.

 “Business Day” is defined as Monday through Friday, excluding the Federal Holidays or as otherwise posted in the bank.

The terms “we”, “our”, and “us,” refer to State Bank of Chrisman.

“You” and “your” refer to anyone authorized to sign checks or make withdrawals on your account(s) and to anyone else you authorize to use the Online Banking on your behalf.

This Agreement is in addition to any other agreements between you and the Bank or disclosures we have provided to you in the past or may make to you in the future.

To access the Online Banking Service you must be an Authorized User. To be an "Authorized User" you must read and agree to the terms of this Agreement, have an eligible account with the Bank, have access to the internet, and have obtained an user ID and password. We may refuse to allow certain accounts, such as accounts with special signature requirements, to become eligible for Online Banking. Online Banking will be available 24 hours a day. However, at certain times and without notice to you, some or all of the Service may become unavailable due to system maintenance.

The Bank reserves the right to amend or terminate this Agreement, the Online Banking or your access to Online Banking at any time without prior notice.

Limited Liability

Except as otherwise expressly provided for in this Agreement or by applicable law, Bank is not responsible for any loss, injury, or damage, whether direct, indirect, special, consequential or otherwise, caused by the Online Banking or your use of the Online Banking.

2. Liability for Failure to Make Transfers

If State Bank of Chrisman does not complete a transfer to or from your account on time or in the correct amount according to the account agreement with you (including, but not limited to, all rules and regulations governing your account) , we will be liable for all losses not to exceed the amount of the transfer. However, there are exceptions. State Bank of Chrisman will not be liable for, including but not limited to, the following:

  • If, through no fault of State Bank of Chrisman, you do not have enough money in your account to complete the transfer; or
  • If circumstances beyond our control prevent the transfer, despite reasonable precautions that have been taken; or
  • If the funds in the account are subject to legal process or other encumbrance restricting such transfer; or
  • If you have not given us complete, accurate, or current account numbers or other identifying information so that we or a merchant institution can properly credit your account; or
  • If you have not properly followed the Online Banking instructions or have provided us with wrong or inaccurate information; or
  • If there is a terminal or equipment failure of which you are made aware at the time you request a transfer; or
  • If your telephone, PC, Online Banking Service was not working properly due to the failure of electronic or mechanical equipment or communications lines, telephone or other connection problems. Normal maintenance, unauthorized access, theft, operator errors, severe weather, earthquakes, floods and strikes or other labor problems; or
  • If there is an allegation of fraudulent activity concerning the account; or
  • If our failure to complete the transfer is in accordance with safe and sound Banking Practices.

3. Exclusions of Warranties

THE INFORMATION CONTAINED OR ACCESSED IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ERROR-FREE OR UNINTERRUPTED SERVICE. IN NO EVENT SHALL THE BANK BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS INFORMATION. THE INFORMATION CONTAINED ON THIS WEB SITE MAY INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES MAY BE PERIODICALLY MADE TO THE INFORMATION CONTAINED HEREIN.

4. Protecting Your Password

The only way to access your accounts via Online Banking is to use your password. The password requirement is designed to prohibit unauthorized use of your accounts. You are responsible for preventing the unauthorized use of your password and should keep your password private at all times.

  • Anyone who has obtained your password may be able to access your account(s) via the Internet Banking.
  • You must notify the Bank immediately if you believe your password has been lost or stolen or you wish to change your password to prevent the unauthorized access of your account(s).
  • You must review your account statements carefully to verify that all items appearing therein were authorized by you.
  • You are responsible for verifying the accuracy of these statements and that the transactions listed thereon were authorized.
  • Failure to notify the Bank promptly of any inaccurate or unauthorized transactions may result in significant loss to you.
  • For your protection, we recommend that you change your password regularly.
  • The Bank is not responsible for any loss you incur as a result of any transaction conducted by any person you have given your password to.

5. Transfers

You may transfer funds between your checking, savings and money market accounts via Online Banking. A transfer initiated via Online Banking before 2:00 p.m. (Central time) on a Business Day will be posted to your account the same day. Transfers after 2:00 p.m. (Central time) or on non-Business Days will be posted the next Business Day. You must have sufficient funds or credit in your account from which you have instructed the Bank to make a transfer. All transfers are subject to the withdrawal restrictions and requirements contained in the Truth-in-Savings Disclosures, which you received when you opened your deposit account.

6. Loan Payment Options

You may make payments on your loans with the Bank as follows:

  • "One-Time Payment" means a single payment that you enter each time you want to make a payment. You schedule the date you want the payment made.
  • "Repeating Payment" means payments are sent automatically on an ongoing basis. You set up the transfer rules regarding their frequency, amount and timing.

7. Loan Payment Procedures

You authorize us to follow your payment instructions. For a One-Time Payment, we will deduct your payment from your checking or savings account on the date you schedule the payment to be sent ("Payment Date") or within 2 Business Days thereafter. For a Repeating Payment, we will deduct your payment from your account on the start date ("Start Date") or within 2 Business Days thereafter; we will deduct subsequent payments from your account using the Start Date as a reference point.

We will not be responsible for: (a) your failure to follow payment requirements; (b) your failure to schedule a proper date for payment sufficiently in advance of the date a payment is due; or (c) any other exceptions stated in this Agreement. Upon termination of the Service, you will be responsible for making arrangements to pay any future or repeating payments.

You are responsible for having sufficient funds on deposit to make payments in full on scheduled dates. We reserve the right to refuse to transfer funds if your designated account has insufficient funds or we have other cause deemed by us to be sufficient.

8. Consumer Accounts

Any owner of a joint account may access the account by applying for and using the Internet Banking, and we are not required to provide prior notice to the other owner(s). Accounts (a) which require the signature of more than one individual for transactions, or (b) for which you are only an authorized signer but have no ownership rights, do not qualify for use via the Online Banking. The Bank reserves the right to determine whether or not an account is eligible to be accessed via the Online Banking.

9. Viruses

The Bank is not responsible for any computer virus or related problems that may be associated with the use of any online system, including the Service. The Bank highly recommends the use of a manufacturer-recommended virus detection software.

10. Fees

Unless otherwise indicated for certain additional features, there are no fees for utilizing the Online Banking. However, fees, as described in the applicable product or account disclosure statement, may apply to services ordered via Online Banking and to transfers from a credit account (e.g. monthly service charges for deposit accounts, finance charges for credit accounts, service charges, overdraft fees, etc.). You may also incur fees for the telephone, equipment and internet services you use to access the service. The Bank retains the right to modify and add fees.

11. Termination

You may terminate your use of the Online Banking by sending the Bank written notice of termination no less than ten (10) Business Days prior to termination at one of the following address: State Bank of Chrisman, 202 West Madison, Chrisman IL 61924 or Paris First, 600 E. Jasper St., Paris, IL 61944. In addition, upon termination of the Online Banking, you must separately cancel all account transfers, line of credit transfers and/or payments scheduled through the Online Banking. If you do not cancel the transactions, such payments or transfers prior to termination of the Online Banking may be completed. We may terminate your use of the Online Banking, in whole or in part for any reason, at any time without prior notice.

12. New Services

We may introduce new features to Online Banking or enhance existing features of Online Banking from time to time. Unless we state otherwise, they will be subject to the terms of this Agreement.

13. Website Ownership

The content, information and offers on our website are copyrighted by the Bank and the unauthorized use, reproduction, linking or distribution of any portion is strictly prohibited.

14. Receipt and Review of all Required Disclosures

You hereby acknowledge that you have received and read this Agreement in its entirety and all applicable account disclosures.

15. Disclosure of Account Information to Third Parties

We will disclose information to third parties about your account or the transfers you make:

  • When it is necessary to complete transfers; or
  • To verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or
  • In order to comply with government agency or court orders; or
  • If you give us written permission; or
  • To provide information regarding improper use of an account or card.

17. Electronic Funds Transfer Errors

In case of errors or questions about your electronic transfers, contact either State Bank of Chrisman at (217) 269-2339 or write to us at: State Bank of Chrisman, 202 West Madison, Chrisman IL 61924; or Paris First (217) 465-6360 or write to us at: Paris First, 600 E. Jasper St., Paris, IL 61944.

We must hear from you within sixty (60) days after the FIRST statement on which the problem appeared was sent to you. Please tell us your name and account number, describe the error or the transfer about which you are unsure and explain why you believe there is an error, and tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or questions in writing with ten (10) business days.

State Bank of Chrisman will tell you the result of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or questions. If we decide to do so, we will credit your account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation.

If State Bank of Chrisman asks you to state your complaint or question in writing and we do not receive it within ten (10) business days, we may not credit your account.

If a notice or error involves an electronic fund transfer that occurred within thirty (30) days after the first deposit to the account was made, the error involves a new account. For errors involving a point-of-sale transaction or a foreign initiated transfer, we may take up to ninety (90) days to investigate your complaint or question. For new accounts, we may take up to twenty (20) business days to credit your account for the amount you think is in error.

If we decide that there was no error, State Bank of Chrisman will send you a written explanation within three (3) business days after we finish our investigation. You may ask for copies of the documents that were used in our investigation.

18. Customer Liability for Unauthorized Transfers

If you believe your password has been stolen notify either State Bank of Chrisman at once (217) 269-2339 or 202 West Madison, Chrisman IL 61924; Paris First (217) 465-6360 or 600 E. Jasper St., Paris, IL 61944. Telephoning is the best way to limit the amount of loss. If you notify us within two (2) business days, you can lose no more than $50.00 if someone has used your password without your permission.

If you do not notify us within two (2) business days after you learn of the loss or theft of your password and we can prove that some of the loss may have been prevented had we been informed of the loss, you can lose as mush as $500.00.

Also, if your statement shows transfers that you did not make, notify us at once. If you do not notify us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time.

19. Email Messages

If you have questions concerning the use of Online Banking, you may send your questions to the Bank and receive answers to your questions through our secure Online Banking email service ("Email"). Email should not be used if you have questions about your accounts, if you discover an account error or if you believe someone else may have access to your password. If you need to contact the Bank immediately because you have questions about your accounts, or about transfers and payments to and from your deposit and credit accounts, please call State Bank of Chrisman immediately at 217-269-2339; or Paris First (217) 465-6360. In addition, you cannot use Email to access the Service, and, therefore, you may not use Email to initiate transfers to or from your deposit or credit accounts, or to access your investment accounts. Under no circumstances will a Bank employee request your username or password via the Internet, Email or by any other means. DO NOT respond to such a request even if the individual claims to represent the Bank and you should not send confidential information via the Internet or Email.

20. Limit of State Bank of Chrisman Responsibility

State Bank of Chrisman hereby disclaims any warranties, endorsements or representation, express or implied, related to any product, service, advertisement or other information contained herein. This includes any content contained, distributed, linked or downloaded from the site. Any products or services from this site are to be used at your own risk, with no obligations or liabilities by State Bank of Chrisman. Any exceptions to this general disclaimer would be outlined within any applicable Service Agreement. State Bank of Chrisman also does not guarantee the quality of any product or displayed materials that are purchased or used by you as a result of an advertisement to which you respond. It will be within the sole discretion of State Bank of Chrisman to correct any errors or to omit any portion of the services, products or materials contained herein.

State Bank of Chrisman agrees to make reasonable efforts to ensure full performance of Online Banking. State Bank of Chrisman will be responsible for acting only on those instructions sent through our Online “message center” customer service channel which are actually received and cannot assume responsibility for malfunctions in communications facilities not under our control that may affect the accuracy or timeliness of messages you send. State Bank of Chrisman will not be responsible for any losses or delays in transmission of instructions arising out of the use of any Access Service Provider or caused by any browser. State Bank of Chrisman is not liable for any computer virus or related problems which may be attributable to services provided by any Access Service Provider.

State Bank of Chrisman is not responsible if you give incorrect instructions, or if your payment instructions are not given sufficiently in advance to allow for timely payments, or if there are delays in mail service.

Except as otherwise provided by law, you agree that State Bank of Chrisman is not responsible for any loss, injury or damages, whether direct, indirect, special or consequential, as a result of the use of Online Banking or arising in any way out of the installation, use or maintenance of your personal computer or software.

State Bank of Chrisman does not make any warranties concerning the hardware, software, services or browser or any part thereof including, but not limited to, any warranties of merchantability or fitness for a particular purpose.
